ORIGINALS ($0.05/word, USD) and
POETRY ($10/poem, USD)
In consideration of the publication of your previously unpublished Contribution, we ask you to grant us exclusive English language First World Rights for 6 months after initial publication, non-exclusive audio rights, and the non-exclusive right to host the story in our archives here (on thedreadmachine.com) and our other content distribution platforms (Patreon and Ko-fi).
REPRINTS ($0.01/word, USD)
In consideration of the reprinting of your Contribution, we ask you to grant us non-exclusive English language print rights, electronic rights, audio rights, and the non-exclusive right to host the story in our archive. We will credit the original publisher and provide a link to where the story was first published.
This agreement is not a transfer of copyright. All rights not expressly granted by you in this agreement reside with you. We will not assign or in any way transfer this contract or the rights granted by it to another person or entity.
In exchange, you will receive monetary compensation from The Dread Machine in the form of a one-time payment. For Originals and Reprints, the payment will be based on the Contribution’s final word count (after editing). Payment is sent via Paypal on the first Monday of the month your Contribution is scheduled to be published.
You and The Dread Machine agree as follows:
Author Photo & Biography
You grant The Dread Machine the right to use your name, image, likeness, and biographical material for all advertising, promotion, and other use of the Contribution. We will use only the name, image, likeness, and biographical material provided and approved by you.
Edits
We use American English and follow the guidelines set forth in the Chicago Manual of Style. The Dread Machine is authorized to edit the Contribution for style, usage, and felicity.
Exclusivity
You agree not to publish or permit others to publish this Work in any form prior to its publication and appearance on The Dread Machine nor until six months after publication. If the Work is selected for a “best of the year” anthology, we agree to waive this clause, provided you give us prior written notice of the selection by such an anthology.
Warranties and Indemnifications
You warrant to The Dread Machine as follows:
i.) You are the sole author of the Contribution;
ii.) you are the owner of all the rights granted to The Dread Machine hereunder and have full power to enter into this agreement and to make the grants herein contained;
iii.) that the Contribution is original and any prior publication of the Contribution in whole or in part has been fully disclosed to The Dread Machine;
iv.) to the best of your knowledge the Contribution does not infringe upon any copyright or upon any other proprietary or personal right of any person, firm or corporation.
You will indemnify The Dread Machine against any loss, injury, or damage finally sustained in a court of law in connection with or in consequence of an intentional breach of one or more the foregoing warranties.
Agreement Governance
Regardless of its place of execution, this agreement shall be interpreted under the laws of the State of Connecticut.
